Why a private lot dock is off the table at Chestatee

Short answer

A Chestatee lot cannot count on a private dock. The covenants bar private docks and boat access to Lake Lanier except those the original developer installed, and the Corps of Engineers permits docks only in certain shoreline areas. Either lock alone would stop most plans. This article explains each and what to do instead.

Under a heavy grey and white cloudy sky, a wide cove holds dozens of motorboats anchored off a long sandy beach backed by low buildings and a wooded ridge; a lone pine and a leafy tree stand at right, and a bare, gravelly bank with patchy grass fills the foreground.

On many parts of Lake Lanier, a buyer asks whether a lot can get a dock and then asks the Corps. At Chestatee the first answer comes from a different document, which is why the question is simpler here than elsewhere on the lake, and also why listing photos that show docks can mislead.

Lock one: the covenants

The covenants bar private docks and boat access to Lake Lanier except docks and boatslips originally installed by or for the Declarant.src

The phrase to notice is “except docks and boatslips originally installed by or for the Declarant”. It tells you that the docks that exist were part of the original plan, and that the rule was written to stop owners from adding more. It also tells you that a dock you can see in a listing photo is not evidence that your lot can have one.

The covenants also bar an adjacent use of the lake: Owners may not draw water from Lake Lanier for lawns, gardens or any other purpose.src

Lock two: the Corps of Engineers

Lake Lanier is a federal project. Lake Lanier is a Corps project in the Chattahoochee and Chestatee river basins; Buford Dam finished impoundment in 1957.src The Corps zones its shoreline, and the zones decide what can be built. Corps shoreline is zoned Limited Development, Public Recreation, Protected and Prohibited Access.src

The key rule for any dock question is this: Private and community docks may be permitted only in Limited Development Areas, which are 47% of the shoreline.src In other words, even if the covenants allowed a private dock, the Corps would permit it only where the shoreline is zoned for that use. We do not tell you which zone any Chestatee lot falls in; only the Corps and a survey can.

Why both locks matter to a buyer

Buyers sometimes hear that a dock permit “can be arranged”. At Chestatee two parties would have to say yes, and the first of them wrote a rule that says no. Either of these is enough to end a plan; together they make a dock a poor thing to price into an offer.

  • If the covenants bar it, the association has the right to enforce that.
  • If the Corps zone does not allow it, no association vote changes it.
  • If both permit it for some lot, you will have a document that says so. Ask for that document.

What to do if boating is the reason you are buying

Start with the marina, but read what the covenants say about slips first. A slip is a separate right granted by the slip owner, not by the lot. If a slip is not available, a public ramp is the fallback: Dawson County Parks and Recreation manages four Lake Lanier parks: Nix Bridge, Thompson Creek, Toto Creek and War Hill, with public boat ramps.src That is day use, not a berth, and it is the honest alternative.

Septic, shoreline and the flood line

Another Corps rule bears on lakefront thinking even if your lot is not on the water: Corps policy bars septic tanks and drain fields on public property below 1,085 feet.src Chestatee has its own sewer system, run by a separate owner, so the practical effect for most buyers is small, but the rule is part of why shoreline questions are never only about a dock. See the lake page for the pool levels.

The short version

Do not pay for a dock the documents will not let you build. Do not accept a seller’s “could be permitted”. If you want a berth, ask the slip owner. If you want a ramp, call the county. If you want to know your lot’s boundary, order a survey and ask the Corps. The options comparer puts the three routes side by side.
