The community
Who runs what at Chestatee
Four different parties can set rules for a Chestatee home: the Corps of Engineers for the lake, Dawson County, the owner-run association managed by HMS, and a separate owner of the golf course, marina and sewer. The association is not the golf club and not the marina. Knowing which is which tells you who to ask.

The Corps of Engineers
Owns and manages the lake and the shoreline around it. Its rules apply on top of everything else.
Ask: Lake Lanier project officeDawson County
Taxes, zoning, building permits, inspections, roads on its project list, animal control and septic or well records.
Ask: County officesThe association (HOA)
Chestatee Community Association, Inc.: the covenants, the amenities, exterior-change approvals and the board. Managed by HMS.
Ask: Association and HMSThe course, marina and sewer owner
A separate owner, not the association, per the association’s own welcome letter. Golf, slips and the sewer bill sit here.
Ask: Club and developer officeThe association: Chestatee Community Association, Inc.
The community homeowners association is Chestatee Community Association, Inc.src The association is managed by Homeowner Management Services Inc. (HMS), 1260 Old Alpharetta Road, Alpharetta, GA 30005, phone 770-667-0595, email HMS@HMS-inc.net.src The association names chestateepoa.com as its HMS Community Website for dues payment, documents, calendar, and board contacts. The site is a member portal.src
Board meetings are held at the Lodge at 5:30 pm on the 2nd Wednesday of each month unless otherwise notified.src Residents are welcome at regular sessions, with an open member-comment forum at the start of each meeting.src The association also publishes role-based board mailboxes rather than named individuals, which is why this guide does the same. The association publishes role-based board email addresses: president@, vicepres@, treasurer@, secretary@, cmrc@ (modification requests), landscaping@, structures@, roads@, recreation@ and waterfront@ chestateepoa.com.src
The separate owner: golf course, marina and sewer
The association's own welcome letter says the golf course, the sewer system and the marina are not managed by the homeowners association; they have a separate owner.src In practice that means three things. Under the covenants the golf course is not association common property, and owning a lot or association membership gives no right to use it; use rights are set by the course owner.src The marina is not managed by the HOA; the welcome letter refers marina questions to the golf club domain contact.src Sewer billing and service go to a Developer Office, not to the association; the phone number is on the directory.
We do not name the private owner of those three businesses. The association’s documents do, and you can read them in the welcome packet, but a guide to a community has no need to put a private person’s name on a web page.
Why this matters in a sale. A listing may say “golf and marina community”. The documents say the association does not manage the course or the marina. Anything a seller says about golf rights, slips or sewer terms needs a written source from the party that actually sets them.
The developer, then and now
The original developer-declarant named in the covenants is Chestatee Development Corporation, a Georgia corporation.src A Partial Termination of Declarant's Rights was recorded March 24, 2023 (Deed Book 1625, Page 67), shifting more control to the owner-run association.src
Dawson County
The Dawson County Government Center is at 25 Justice Way, Dawsonville, GA 30534; main phone 706-344-3500.src The county handles taxes, zoning, building permits and inspections, animal control and septic and well programs. The county road project page places Night Fire Drive and Dogwood Way in Dawson County.src
The Corps of Engineers and the lake
The covenants state lake and Corps-shoreline use is governed by the association's rules in addition to any rules of government agencies with jurisdiction.src The Corps Lake Lanier Project Management Office is at 1050 Buford Dam Rd, Buford, GA 30518, phone 770-945-9531.src
The practical rule is simple: the strictest applicable rule wins, and you have to read all of them. The covenants page goes through the association’s side, and the lake page covers the Corps.
