Short-term rentals and Chestatee: the covenant says no

Short answer

An amendment to the Chestatee covenants expressly prohibits short-term rentals, whether or not the owner lives in the home. That matters most to anyone buying for rental income. This article explains what the amendment says, why it is the answer a listing may not volunteer, and what to ask the association before you offer.

Beyond a dark wooden rail fence and a parking lot full of pickup trucks and SUVs with boat trailers, a boat ramp slopes into a broad blue lake dotted with motorboats, a small sailboat and a low grassy islet with one tree, backed by a continuous wooded shoreline under a blue sky with scattered white clouds.

Short-term rental, the nightly and weekend booking of a home through a platform, is why many buyers look at lake-area houses. Chestatee is a clear example of a community where the answer is no, and the reason sits in a recorded document that the listing may never mention.

What the amendment says

Short-term rentals (Airbnb, VRBO and similar) are expressly prohibited by an amendment to the covenants, whether or not the owner lives in the home.src

Two points deserve attention. First, it is an amendment, which means it was added to the covenants after the original recording. The Declaration of Protective Covenants for Chestatee was recorded in Dawson County deed records at Deed Book 266, Page 2, in 1998.src Second, it applies “whether or not the owner lives in the home”, which closes the common argument that a primary residence is exempt.

Why a listing may not mention it

A listing is written to attract a buyer. It will happily describe a lake-area home’s amenities and say nothing about a restriction on how you use it. That is not necessarily dishonest, because the listing is not the legal document, but it puts the work on you. The restriction is in the covenant packet, not in the photo captions.

How to confirm it, step by step

  1. Get the amendment text.Ask the management company for the recorded amendment itself, with its recording date and reference. HMS offers a Welcome Packet (covenants, bylaws, rules, policies) as a public download; the copy read for this research is titled Welcome Book updated 2026-04-06.src
  2. Ask what counts as short term. The amendment defines it, and the definition is what applies to a guest staying a long weekend or a month. Read the definition, not our summary.
  3. Ask about enforcement. We did not find how the association enforces the rule. Ask what the process and the consequences are, in writing.
  4. Ask about leases. We did not read a rule on long-term leasing. If you plan to rent the home on a lease, ask the association what its rules require, and ask for them in writing.
  5. Tell your attorney. An attorney who reads covenants can say whether the amendment covers your plan and whether a change is possible.

Should this change your offer?

If the home was priced on rental income, it should. If you plan to live in it, it may not matter. If you plan to rent by the month, you need an answer on leases first. What you cannot do is promote it as a rental on a platform and expect the association to ignore the covenant. Do not rely on a seller or listing agent who says it is “fine”; the person with the authority is the association.

What the county adds

County rules about lodging and permits are separate from the covenant. The association’s prohibition is the stricter and the one that applies first. If you want to ask the county, its main line is on the directory.

A kinder way to read it

For owners who live here, the rule protects what they bought: a neighborhood where the person next door is a neighbor and not a rotating guest. For investors, it is a clear boundary that saves a failed plan. The restriction is public, it is dated, and it is easy to find if you ask. The mistake is not asking.
